Why India went to ICJ to save Kulbhushan Jadav?

Ramoynd Davis, a CIA agent killed two Pakistani national in broad daylight at a traffic signal in Lahore. Davis was charged with murder case but Americans took the matter seriously and forced Pakistan Government to release him after payment of millions of dollars to deceased's families. This shows that powerful nations value the life of their citizens and particularly those who work for government. They would go all the way to save the life of their citizens in a foreign country even if he/she is guilty. Many Indian spies or nationals have been captured in foreign countries including Pakistan in past, but India never went all out to save their life. This time India went to ICJ (International Court of Justice) to save Kulbhushan’s life. It shows a change in Indian policy under Modi. India is acting live a country which values its citizens and willing to take extra mile to save their life.Kulbhushan Jadhav is a former Indian Navy officer who was dhow some business near the Iranian port of Chabhar. Pakistan claims that Jadhav was captured near a remote town of Baluchistan called Mashke near the Iranian border. As per some Indian newspaper reports, it is believed that Jadhav may not be just doing dhow business in Iran. He probably transported drugs and contraband, either independently, or for the Baloch drug cartel. It was also reported in media that Jadhav had approached Indian spy agency RAW many times to work for them but his offer was rejected every time. Now Indian security establishment believed that Jadhav may have been fooled by some Baloch drug dealers and those dealers might have handed him to Pakistani spy agency ISI. There are many loopholes in Pakistani theory that Jadhav is an Indian spy like Countries don’t send former military officers as a spy, spy is trained in local custom & language, no spy acknowledges all the charges, spy agency don’t make a fake passport on correct address etc. Even a former Pak military has said that Jadhav was captured inside Iran not Pakistan. Jadhav was not given a proper trial. He was sentenced to death by a summary military trail.Let us leave the legal matters of ICJ regarding consular access, Vienna convention and 2008 Indio-Pak agreement on consular access. The most important question is that why India took such effort to take the matter. There are two explanations apart from the fact that Modi Government is now willing to save Indian live abroad. First one is that India wants to expose Pakistan on this matter. How can a military court martial retired officer of another country? And Pakistan should give a fair trial to an Indian national irrespective of his involvement in terrorism. Another point is that India wants to keep Pakistan engaged with Kulbhushan topic. Whole Pakistan Media is behind this topic. It is like hanging a bell in the neck of a bull and bull will be busy with that bell. It is very difficult for India to save the life of Kulbhushan Jadhav. But this stay order in ICJ on his hanging has given a window of opportunity to India to highlight this matter in front of world. Who knows India might attempt a cold war type spy swap? As per Pakistani Media reports India might have kidnapped retired Pak Army Lt Col Mohammed Habib Zahir and he can be used to swap Jadav. Anything is possible in diplomacy and we can’t rule out any option. But we should praise Indian Government to take this extreme step to save an Indian life.
